Truck drivers need to protect their CDL's

A commercial driver's license is vital for truck drivers. Their livelihood depends on it. A traffic citation can seem innocuous, but can jeopardize their CDL. Since truck drivers drive thousands of miles a year, they are more likely to get a ticket than the average driver. Any CDL holder should consult with an attorney immediately after receiving a citation.


For CDL purposes, a probation before judgment counts the same as a conviction under federal law and Maryland law. So while you may not receive the points, your CDL can be suspended or disqualified.


A driving under the influence conviction or probation before judgment will result in a one year suspension for a first offense and a disqualification for life for a second offense. Other charges such as leaving the scene of the accident can have similar ramifications. Certain speeding tickets can also be problematic.


Tractor trailer drivers can also receive tickets for exceeding weight limits for many thousands of dollars. I have represented clients with citations for over $20,000.00.


If you receive a citation and have a CDL, do not pay it. Reach out to an attorney to determine the potential consequences. An attorney can often protect your CDL by negotiating a plea deal to a lesser offense.
