A DUI Probation Before Judgment Can Now Be Expunged

Effective October 1, 2024, you can now get a DUI expunged if you received probation before judgment.

A new law has taken effect that will benefit many people that received DUI's over the years. Anyone who received probation before judgment for a DUI or DWI may now be eligible for expungement 15 years from the end of probation. This is a major change as previously a PBJ for a DUI could not ever be expunged.


The new law took effect October 1, 2024, but applies to anyone who received a PBJ prior to that date. There are several requirements. First, the individual must wait 15 years from the end of probation to file for expungement. Second, the individual cannot have any subsequent convictions or charges that are not eligible for expungement. Third, the State can object if the probation was not successfully completed.


This is a major change in the law. An expungement will allow individuals to clean up their record and remove embarassing entries from Maryland Judiciary Case Search. Anyone eligible for expungement should file immediately.
