Certain felonies can be expunged in Maryland

Many people do not know that there are some felony convictions  that can be expunged. This is important because felony convictions can affect your ability to get a job or rent an apartment. No one wants to be labeled as a convicted felon.


Until recently, only a probation before judgment could be expunged for a felony. This was unfair to those who made mistakes in their youth and are still paying a severe price for it. As a result, the legislature passed the Maryland Second Chance Act to allow certain convictions to be expunged. The law is codified in Section 10-110 of the Criminal Procedure Article Annotated Code of Maryland. In fact, every year, more convictions are expungable as the legislature broadens the statute.


As of today, the following felonies can be expunged:

  1. Felony theft;
  2. Possession with intent to distribute a controlled dangerous substance;
  3. Second degree, third degree, and fourth degree burglary;
  4. An attempt or conspiracy to commit any of these offenses.

There are other criteria to get your record expunged. You must not have any pending charges and you must not have any subsequent charges that also cannot be expunged. Most importantly, there is a waiting period from the end of your probation or sentence. There is a $30.00 filing fee.


You  should get your record expunged as soon as possible if you are eligible. It is a simple and inexpensive process.
