Shielding a Protective Order or Peace Order

Protective Orders and Peace orders can sometimes be shielded.

A protective order or peace order is a type of restraining order. If it is granted, a person is ordered to stay away from the another individual. A violation is a criminal offense and carries possible jail time.


These orders are public record. Anyone can see them even if they were denied or dismissed. A prospective landlord or employer may see them and refuse rent or employment. Therefore, it is important to get them shielded if you are eligible.


Protective orders and peace orders cannot be expunged. They can only be shielded. Shielding means that they are hidden from public view, but they can still be seen by police, prosecutors, and judges.


Not all protective and peace orders can be shielded. To be eligible, the order must have been denied, dismissed, or you must have consented to the relief. If you had a full hearing and the order was granted, it can never be shielded.


In addition, to get your record shielded, the order must have expired and you cannot have any pending criminal charges involving the same parties. There must be a hearing and the petitioner can attend and object in which case the decision will be up to the judge.


It is a good idea to get a protective order or peace order shielded if you are able. This will remove it from Maryland Judiciary Case Search and keep it hidden from the public.
